These Terms govern your use of the ScubaOS applications (iOS, Android and desktop), the website at scubaos.app, and the optional account and social features (together, the “Service”). The Service is provided by Piers Jennings, trading as My SEO Growth (“we”, “us”). You can reach us at [email protected]. By using the Service you agree to these Terms.
1. Who can use ScubaOS
You must be at least 13 years old to create an account or share content. If you are under 18, you confirm that you have your parent or guardian's permission. We do not knowingly allow children under 13 to create accounts; if we learn that we hold data from a child under 13, we will delete it.
2. The dive-planning disclaimer: read this
ScubaOS is a planning and logging aid only, to be used alongside your certified dive computer, never instead of it. It is not a dive computer, not a substitute for proper training, certification, supervision, or a working, certified dive computer, and not life-safety equipment. Before you first use the planner, the app asks you to acknowledge exactly this.
- The planner is for divers trained and certified for the dives they plan. Only plan dives within your certification and experience. If your training doesn’t cover a dive, no schedule from ScubaOS makes it diveable.
- Check every schedule yourself, against your training, your agency’s tables and your dive computer’s own planner, before you get in the water. If you cannot verify a plan, don’t dive it.
- Decompression and gas calculations are estimates produced by a model. No model guarantees a dive is safe.
- Always dive within your training and experience, follow your agency's procedures, and rely on your certified dive computer and your own judgement in the water.
- You dive entirely at your own risk. We are not responsible for loss or damage arising from reliance on plans, logs or any output of the Service (see section 9 for what this does not and cannot exclude).
3. Your account
You are responsible for your account and for keeping your credentials secure. You may delete your account at any time from within the app; doing so permanently removes the account and the content you have shared on our servers (your on-device dive log remains on your device). We may suspend or terminate accounts that breach these Terms or our Acceptable Use Policy.
4. Your content
Dives, photos, comments and other material you create are yours. When you share them through the Service, you grant us a limited, non-exclusive licence to host, store and display that content solely to operate the social features for the people you've chosen to share with. You are responsible for the content you post and confirm you have the right to share it. Anything you post must comply with our Acceptable Use Policy and Child Safety Standards.
5. Moderation
You can report content and block other users in the app. We may review, remove or restrict content and suspend users where content breaches these Terms or the law. Some checks are automated: certain profanity is masked (starred out) in feed text, and known illegal material is blocked. We are required to act on, and may report, certain illegal content (see our Child Safety Standards). If you believe we removed something wrongly, or failed to act on something you reported, contact [email protected]; you do not need an account to complain.
6. Fees
ScubaOS is free at the core. Paid features are described clearly before you buy them and are purchased through Apple’s App Stores (including the Mac App Store) or Google Play under their terms. Plus is a one-time purchase. Pro is an auto-renewing subscription: after any free trial it renews automatically until you cancel in your store’s subscription settings, and access continues to the end of the period you have paid for. Refund requests and cancellation rights for store purchases are handled through the store you bought from.
If you are a consumer in the UK or EU, nothing in these Terms affects your statutory rights, including your rights in relation to digital content that is faulty or not as described.
7. Intellectual property
The ScubaOS name, logo, app and website are ours or our licensors'. These Terms don't grant you any rights in them beyond using the Service as intended. ScubaOS uses open-source components under their respective licences.
8. Availability & changes
We may change, suspend or withdraw features, and we may update these Terms. If we make material changes we'll take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept them.
9. Liability
Beyond the dive-planning disclaimer in section 2, and to the fullest extent permitted by law, the Service is provided “as is”. Nothing in these Terms limits liability that cannot lawfully be limited (including for death or personal injury caused by negligence, or for fraud).
10. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless mandatory law in your country of residence says otherwise.
